About the Settlement
A settlement has been reached in a class action lawsuit against Thorek Memorial Hospital. The lawsuit alleges that Thorek Memorial Hospital ("Defendant") collected, stored, used, and disseminated employees' biometric identifier(s) and/or biometric information in violation of the Illinois Biometric Information Privacy Act ("BIPA"). Defendant contests these claims and denies that it violated BIPA.

Who is Included in the Settlement?
You are a member of the Settlement Class if you:
- Were an employee of Thorek Memorial Hospital, Thorek Memorial Hospital Andersonville, Thorek Memorial Hospital Retirement Home, Methodist Hospital of Chicago, or Bethany Retirement Community;
- Scanned your fingers, hands or palms, and/or fingerprints or handprints using a Biometric Timekeeping System during the period beginning on May 11, 2016;
- Were hired prior to May 3, 2021; and
- Did not previously execute a severance or settlement agreement with Thorek or were not a member of a union during their employment with Thorek.
Your Legal Rights & Options
Option 1: Accept the Settlement
To accept the Settlement, you do not need to do anything. If you are a member of the Settlement Class, you will receive a payment automatically unless you exclude yourself.
Option 2: Exclude Yourself
If you do not want to participate in the Settlement, you must send a written request for exclusion to the Settlement Administrator by July 7, 2025.
Your request must include:
- Your name, address, and telephone number
- The name and number of this case
- A statement that you wish to be excluded from the Settlement Class
- Your personal signature

Option 3: Object to the Settlement
If you wish to object to the Settlement, you must submit a letter or brief to the Court by July 7, 2025.
Your objection must include:
- Your full name, address, telephone number, and email address
- The case name and number of this lawsuit
- All grounds for the objection with factual and legal support
- Identification of any other objections you have filed in other class action cases
- A statement of whether you are represented by counsel and a list of all objections filed by that counsel
- A statement of whether you intend to appear at the Final Approval Hearing
- Your personal signature
Payment Information
If the Settlement is approved, you will receive payment either by check or electronic payment. You can elect to receive your payment electronically through Venmo, Zelle, or PayPal.
